By using this website, submitting a quote request, placing an order, or participating in the KC Exclusives community forum, you agree to these Terms of Service in full. If you do not agree, please do not use this site or our services.

All KC Exclusives orders are custom-made to your specifications. Because each piece is handcrafted specifically for you, we begin production only after you have approved the design and pricing. Please review all order details carefully before approving — changes after production begins may not be possible.

By submitting artwork, designs, logos, photographs, names, slogans, or other content ("Customer Content") to KC Exclusives for use in a custom order, you represent and warrant that: (a) You own all rights to the Customer Content, or you have obtained all necessary licenses, permissions, and consents required to authorize KC Exclusives to reproduce it; (b) The Customer Content does not infringe upon the intellectual property rights, privacy rights, or any other rights of any third party; (c) You have the authority to grant KC Exclusives the right to reproduce the Customer Content for the purpose of fulfilling your order. You agree to indemnify, defend, and hold harmless KC Exclusives and its owner from any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from any Customer Content you submit, including without limitation claims of trademark, copyright, right of publicity, or trade dress infringement. KC Exclusives reserves the right to decline any order that appears to involve infringing or unauthorized content.

Payment is due upon order approval and before production begins. Accepted payment methods will be communicated directly. Prices are confirmed in your personalized quote and are valid for 30 days from the date issued.

Standard production time is 1–2 weeks from the date of payment. Rush orders may be available for an additional fee — mention your deadline in your quote request. KC Exclusives is not responsible for delays caused by shipping carriers once your order has been handed off.

Because all items are custom-made, we do not accept returns or exchanges unless the item was made incorrectly or arrived damaged. If there is an issue with your order, please contact kara@kcexclusives.com within 7 days of receiving your package and we will make it right.

KC Exclusives retains the right to photograph and share completed orders on social media and marketing materials unless you request otherwise in writing prior to order fulfillment. Photos containing identifiable individuals require separate written consent from those individuals (or a parent/guardian for minors).

The KC Exclusives Cheer Collective forum allows registered users to post content including text, links, and other materials ("User Content"). By posting User Content, you grant KC Exclusives a non-exclusive, royalty-free, worldwide license to display, distribute, and moderate your User Content on this platform. You represent and warrant that your User Content: (a) does not infringe any third party's intellectual property rights; (b) is not defamatory, harassing, hateful, or harmful; (c) does not contain personal information of others without their consent; (d) complies with all applicable laws. KC Exclusives reserves the right to remove any User Content at its sole discretion and to terminate user accounts for violations of these terms.

The community forum is intended for users 18 years of age or older. By creating an account and posting, you confirm you are at least 18 years old, or that you are a parent/guardian posting on behalf of a minor and accept full responsibility for that minor's use of the platform. Prohibited conduct includes: harassment or bullying of any individual; doxxing or sharing others' private information; spam or commercial solicitation; copyright infringement; impersonation; content that sexualizes minors in any way. Violations may result in immediate account termination and, where required by law, reporting to appropriate authorities.

KC Exclusives respects intellectual property rights. If you believe content on this site infringes your copyright, please contact us at kara@kcexclusives.com with: (a) identification of the copyrighted work; (b) identification of the infringing material and its location on our site; (c) your contact information; (d) a statement that you have a good faith belief the use is unauthorized; (e) a statement under penalty of perjury that the information is accurate and you are authorized to act on behalf of the copyright owner. You agree not to: use this site for any unlawful purpose; attempt to gain unauthorized access to any portion of the site; transmit malware or harmful code; scrape or harvest data without permission; use automated tools to submit quote requests; impersonate KC Exclusives or any other person.

You agree to indemnify and hold harmless KC Exclusives and its owner, employees, and agents from any claims, damages, losses, and expenses (including attorneys' fees) arising out of: (a) your use of this website; (b) any Customer Content you submit; (c) your violation of these Terms; (d) your violation of any applicable law or third-party right.

To the maximum extent permitted by applicable law, KC Exclusives is not liable for indirect, incidental, special, consequential, or punitive damages arising from the use of our products, services, or this website. Our total liability is limited to the amount paid for the specific order in question. Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above limitations may not apply to you.

These Terms of Service are governed by the laws of the State of New Jersey, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of our services shall be subject to the exclusive jurisdiction of the state and federal courts located in Burlington County, New Jersey. You consent to the personal jurisdiction of such courts.

We encourage you to contact us first at kara@kcexclusives.com to resolve any dispute informally before initiating formal proceedings. For disputes where informal resolution fails, parties agree to attempt mediation before filing suit. Nothing in this section prevents either party from seeking injunctive relief for intellectual property infringement.

KC Exclusives is not liable for delays or failures in performance resulting from circumstances beyond our reasonable control, including natural disasters, supply chain disruptions, carrier delays, power outages, or other events outside our control. We will communicate expected delays as promptly as possible.

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions will continue in full force and effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and KC Exclusives regarding your use of this website and our services. They supersede all prior agreements, representations, or understandings, whether written or oral. No verbal or email representations by KC Exclusives constitute a modification of these Terms.

KC Exclusives reserves the right to modify these Terms at any time. We will update the "Last Updated" date at the top of this page and, for material changes, post a notice on the website. Continued use of the site after changes take effect constitutes acceptance of the revised Terms.
